2. Acceptance
By using the Website or submitting your details to us, you confirm that you have read, understood and accept these Terms and our Personal Data Protection Policy. If you do not agree, please stop using the Website.
3. What we do, and what we do not do
This is the most important clause. Please read it carefully.
The Company provides consulting, connection and introduction services between Vietnamese workers and employers in Poland and the European Union, together with support in preparing documentation.
- The Company is not a holder of a Vietnamese licence to send workers abroad under contract.
- The Company is not your employer and does not pay your wages.
- For candidates departing from Vietnam, the contract to work abroad is signed between you and a licensed Vietnamese dispatch enterprise. We will identify that enterprise to you in writing before you sign anything.
- Your employment contract is signed between you and the employer in Poland.
Our role is coordination, advice and support. We do not replace or act on behalf of the parties above in your contractual relationship with them.
4. Candidate eligibility
- You must be 18 years of age or older when you register. We do not accept applications from minors.
- You must provide truthful, accurate and valid information and documents.
- You are responsible for consequences arising from inaccurate information or invalid documents you supply, including refusal of a work permit or visa.
5. Job information on the Website
Roles published on the Website reflect information supplied to us by employers or partners at the time of publication.
- A job listing is not an offer of employment and does not create a contract.
- Pay, working hours, accommodation and other conditions may change and are binding only once written into the employment contract you sign with the employer.
- Gross pay (brutto) is the contractual rate. Net pay (netto) is indicative only and depends on tax, insurance and deductions under Polish law at the relevant time.
- Any VND figure is indicative, converted at the exchange rate and date stated in the listing. Actual remittance rates are usually lower than the reference rate.
- A role may be closed or suspended at any time at the employer’s discretion.
6. No guaranteed outcome
We do not guarantee that you will be selected, that a work permit will be granted, that a visa will be issued, or that you will be admitted to Poland. Those decisions rest with the employer and with the competent authorities of Poland and Vietnam. Processing times are outside our control.
We make no promise regarding extension of residence, change of residence status, or long-term settlement in Poland or any other country.
7. Costs and payment
- All costs and the payment schedule will be given to you in writing before you commit or pay anything.
- Costs include third-party invoiced items such as state and consular fees, medical examination, judicial record certificate, translation and notarisation, together with our document-execution and support package.
- Every amount collected is documented. You may request copies of the documentation at any time.
- Where the parties agree a co-owned savings account or deposit, its ownership, conditions and release date must be set out in writing in a separate contract. Those funds remain your property.
- We do not collect undocumented cash and we will never ask you to transfer money to a staff member’s personal account.
8. Refunds and termination
Refund conditions are set out in the service contract you sign. As a general principle, third-party costs already incurred and documented are not refundable, while amounts not yet spent are refunded. You may withdraw at any time by written notice.
9. Personal data
We handle your personal data in accordance with our Personal Data Protection Policy, which follows Law No. 91/2025/QH15 on Personal Data Protection and Decree No. 356/2025/ND-CP.
10. Complaints
If you are unhappy with our service or believe you have been treated improperly, write to contact@akayprogram.org or call the number in clause 1. We acknowledge complaints within 3 working days and respond substantively within 15 working days. Making a complaint does not affect your position in any application in progress.
11. Use of the Website
You agree to use the Website lawfully, not to copy or redistribute its content without our written consent, and not to interfere with its technical operation.
12. Intellectual property
All content, images, logos and design on the Website are owned by the Company or lawfully used by it.
13. Third-party links
The Website may link to third-party sites. We are not responsible for their content, policies or security.
14. Limitation of liability
To the extent permitted by law, the Company is not liable for indirect loss arising from use of the Website, temporary unavailability for technical reasons, or errors in third-party information published by us in good faith. Nothing here excludes liability that cannot lawfully be excluded.
15. Changes to these Terms
We may update these Terms. Updates are posted on this page with the revision date. Continued use after an update means you accept it.
